These Terms of Service (“Terms”) govern your access to and use of ChurchHost services and website. ChurchHost is operated by Sunday Pixels, LLC, doing business as ChurchHost (“ChurchHost,” “we,” “us,” or “our”). By using our website or services, you agree to be bound by these Terms. If you do not agree, do not use the website or services.

1. Company Information

Sunday Pixels, LLC has filed to do business as ChurchHost with the Texas Secretary of State.

2. Scope of Terms

  1. These Terms apply to:
    1. Website visitors – anyone accessing or using ChurchHost’s website
    2. Customers – anyone purchasing or using ChurchHost hosting services
  2. Certain provisions apply only to customers, while others apply to all users.

3. Definitions

  1. Services: All web hosting, email hosting, managed WordPress hosting, backups, client portal, control panel and related services provided by ChurchHost.
  2. Customer Content: All files, data, text, images, media, databases, scripts, and other content uploaded, stored, or transmitted by a customer using the Services.

4. Website Use & Intellectual Property

  1. The website is for informational and business purposes only.
  2. You agree not to use the website for unlawful, abusive, or harmful purposes.
  3. Intellectual Property: All content on the ChurchHost website, including text, graphics, logos, and software, is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission.
  4. ChurchHost is not responsible for third-party websites linked from the ChurchHost website. Use of third-party sites is at your own risk.

5. Services Provided

  1. ChurchHost offers:
    1. Shared hosting
    2. Managed WordPress hosting
    3. Email hosting
    4. DNS hosting
    5. Website backups
  2. Services are intended primarily for churches, denominations, nonprofits, agencies, and freelancers. ChurchHost reserves the right to approve or deny service requests at its sole discretion.
  3. Managed WordPress Hosting: Includes general WordPress support. Does not cover third-party plugins, themes, or custom development. Optional automatic updates, staging, and a Web Application Firewall (WAF) are included.

6. Billing, Payments & Refunds

  1. Services are billed in U.S. dollars, monthly or annually, and renew automatically unless canceled.
  2. Payments are processed via Stripe (credit/debit cards).
  3. Late payments may result in suspension 5 days after the due date and termination 30 days after the due date.
  4. Refunds:
    1. New services are eligible for a 30-day money-back guarantee.
    2. Annual plans canceled early may receive prorated refunds, upon request, at ChurchHost’s sole discretion.
    3. Refunds do not apply to accounts suspended or terminated for violation of these Terms or the Acceptable Use Policy.

7. Acceptable Use Policy

It is a material condition of your use of ChurchHost Services that you comply with the following rules and restrictions.

  1. You may not use the Services to:
    1. Violate any applicable law or regulation.
    2. Host, transmit, or distribute malware, viruses, spyware, ransomware, or malicious code.
    3. Engage in phishing, scams, fraud, or identity theft.
    4. Exploit or harm minors.
    5. Host adult, violent, or illegal content.
    6. Send unsolicited bulk email, operate open relays, or abuse email services.
    7. Consume excessive server or network resources, interfere with other customers, or disrupt ChurchHost systems.
    8. Infringe intellectual property rights.
  2. Enforcement: Violation constitutes a material breach and may result in immediate suspension or termination at ChurchHost’s sole discretion, without prior notice.

8. Customer Responsibilities

Your responsibilities as a ChurchHost customer include:

  1. Follow the Acceptable Use Policy.
  2. Maintain accurate account information.
  3. Keep credentials secure. Use strong passwords and enable two-factor authentication (2FA) when possible.
  4. Generate, download and test independent backups of all files, databases and other data in your account.
  5. Promptly report security breaches, service errors, or suspicious activity.
  6. Website Migration/Import: Ensure completeness of any website migration or import. ChurchHost’s import service may not transfer all content, files, databases, settings, or features from a previous host. Customers must verify all desired content is transferred before connecting domains or terminating prior hosting services.

ChurchHost is not liable for any loss, corruption, or unauthorized access resulting from failure to meet these responsibilities.

9. Customer Content & Data Migration

Regarding Customer Content, you understand that:

  1. You are solely responsible for all Customer Content.
  2. ChurchHost does not monitor content but may remove material that violates these Terms or poses security risks.
  3. Website Migration/Import Disclaimer: Whether performed by you or ChurchHost, it is your responsibility to ensure all desired content, files, databases, emails, and other data are successfully transferred before connecting your domain or canceling prior hosting services. ChurchHost’s import services and instructions are provided solely to assist in transferring website files and databases and do not guarantee that all content, settings, or features from your previous host will be transferred or function as expected.
  4. ChurchHost may scan accounts for malware or abuse and take corrective action as necessary.

10. Customer Service Policy

ChurchHost provides customer support as follows.

  1. Support Channels: Client portal tickets (login required), AI chatbot (24/7), email for sales, self-service knowledgebase.
  2. Response Times: AI chatbot responses are near-instant. Tickets are typically answered within 1 business day; high-priority issues are answered first.
  3. Scope of Support: Hosting, server issues, account access, WordPress core support, email and backups. Does not cover third-party software, custom development, or malware cleanup.
  4. Support is provided on a commercially reasonable, best-effort basis. ChurchHost does not guarantee response times or issue resolution.

11. Suspension, Termination & Enforcement

ChurchHost may suspend or terminate Services as follows.

  1. ChurchHost may suspend or terminate Services at its sole discretion, without prior notice, for:
    1. Non-payment
    2. Violation of these Terms or the Acceptable Use Policy
    3. Security risks or abuse
  2. Termination does not release you from payment obligations. Data may be deleted and is not guaranteed to be recoverable.

12. Backups, Uptime & Disclaimer

  1. Automatic backups are provided as a convenience; customers remain responsible for independent backups.
  2. Services are provided on a best-effort basis and “as-is.”
  3. To the fullest extent permitted by law, ChurchHost disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability & Indemnification

  1. You are responsible for all activity under your account, to the fullest extent permitted by law.
  2. ChurchHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  3. Total liability is limited to amounts paid for Services in the 12 months preceding the claim.
  4. You agree to indemnify, defend, and hold harmless ChurchHost, its affiliates, officers, directors, and employees from any claims arising from your content, actions, or use of Services.

14. Changes to Terms & Governing Law

  1. ChurchHost may update these Terms at any time; continued use constitutes acceptance.
  2. Governing law: Texas, with venue in Tarrant County, Texas.
